Important: PositionTracker is a read-only portfolio tracking tool. We do NOT execute trades, move money, or have custody of any funds. We cannot access your brokerage login credentials.
1 Agreement to Terms
By accessing or using PositionTracker ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
2 Description of Service
PositionTracker is a portfolio tracking and visualization platform that allows users to:
Track stock positions, price targets, and alerts
Connect accounts via Plaid for read-only holdings access
View portfolio analytics and AI-powered insights
Manage notes and research related to investments
3 User Accounts
3.1 Registration Requirements
To use certain features of the Service, you must register for an account. You agree to:

You are responsible for safeguarding your account credentials. You must notify us immediately of any unauthorized use of your account.
3.3 Multi-Factor Authentication
Security Requirement: Financial features, including brokerage account connections, require phishing-resistant multi-factor authentication (passkeys or hardware security keys). By using these features, you agree to maintain MFA on your account.
4 Financial Data and Plaid
4.1 Plaid Integration
When you connect a brokerage account through Plaid:

You authorize Plaid to access your account information
Read-Only Access
We receive holdings, transactions, and account metadata
Credential Safety
Your brokerage credentials are never shared with or stored by us
Disconnect Anytime
You can disconnect at any time through Settings
4.2 Data Accuracy
While we strive for accuracy, we do not guarantee that financial data displayed is complete, current, or error-free. Always verify important information with your brokerage directly.
4.3 Not Financial Advice
The Service is for informational and educational purposes only. Nothing in the Service constitutes investment advice, tax/legal/financial planning advice, an offer to buy/sell securities, or a solicitation of investment. Always consult qualified professionals before making investment decisions.
5 Acceptable Use

You may use the Service for personal, non-commercial portfolio tracking and analysis.

6 Intellectual Property
The Service and its original content, features, and functionality are owned by PositionTracker and are protected by international copyright, trademark, and other intellectual property laws.
Your portfolio data and user-generated content (notes, targets, etc.) remain your property. By using the Service, you grant us a limited license to process this data to provide the Service.
7 Subscriptions and Billing
Plans
The Service offers free and paid subscription plans. Features and limits vary by plan level.
Payment
Paid plans require agreement to pay fees. Subscriptions renew automatically unless cancelled.
Price Changes
Prices may change with advance notice. Refunds provided at our discretion.
Cancellation
Cancel anytime. Access continues until the end of your billing period.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
9 Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted or error-free, that data will be accurate or up-to-date, that the Service will meet your specific requirements, or that any errors will be corrected.
10 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSITIONTRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
In no event shall our total liability exceed the amount you paid us in the twelve (12) months prior to the claim.
11 Indemnification
You agree to indemnify and hold harmless PositionTracker, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit to the Service
12 Termination
By You
You may terminate your account at any time through Settings. Your right to use the Service ceases immediately.
By Us
We may suspend or terminate your account for Terms violation, fraudulent activity, non-payment, or extended inactivity.
Effect
Upon termination, we will delete your data according to our Data Retention Policy.
13 Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the new Terms.
14 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
15 Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that you may assert claims in small claims court if eligible.
YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.
16 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
17 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PositionTracker regarding the Service.
