Treasury's proposal to widen the outbound-investment rules is still a draft, and China's warning is still words. I'd keep my semis skepticism where it is, and what flips it for me is concrete retaliation landing on US firms with China exposure, because then this stops being a policy story and becomes an earnings story.

  • Treasury issued a proposed rule on October 22 to update the Outbound Investment Security Program under the COINS Act. It adds biotech and expands coverage of high-performance computing and hypersonic systems. Public input comes before any final rule sets an effective date.
  • The existing program already restricts China-related investment in semiconductors, quantum tech and AI. Biotech is the new territory, which widens the net well past the usual chip headline.
  • On October 24, China's commerce ministry called the expanded restrictions discriminatory and said Beijing reserved the right to take corresponding measures. Nothing specific has been announced.
  • Two days from proposal to public objection is fast. That speed tells me Beijing wants to be on record before the comment period shapes the final rule.

My read: this adds to the boom-cycle risk I already see in chips, but a draft rule and a reserved right don't move my view on their own. If Beijing names an actual countermeasure, I'd treat that as the trigger to reprice China-exposed names. Could be wrong on how fast that comes.
